We periodically appoint digital marketing agents to conduct marketing activity on our behalf, such activity may result in the compliant processing of personal information.  Our appointed data processors include:

How we use your information to make automated decisions

When providing our services, we sometimes use systems to make automated decisions based on personal information we have, or have collected from others, about you and/or your organisation. This helps us to ensure that our decision-making is as efficient as possible.

If you choose not to give your personal information

If you choose not to give your personal information it may prohibit us from fulfilling our contractual obligations to you and we may not be able to provide the services you have purchased.

How long we keep your personal information

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. This means we will generally hold your personal information for a minimum of 7 years after the end of our relationship with you.  We may also hold your personal information for marketing purposes for so long as we have your consent or are legitimately carrying out marketing activity.   If you wish to know how long we may hold your particular personal information as a record of a particular matter then please e-mail info@scotwork.com.

Where we hold your personal information internationally

Your data is held on a Microsoft Azure secure server in a data centre in Dublin with a backup server in Amsterdam. Microsoft security procedures meet rigorous industry standards for compliance.

Using our website

Data you provide via our website will be used to:

  • Improve our products and services
  • Improve the performance of our website
  • Direct emails to you with information on our services that you have indicated an interest in.

We will seek your consent for information to be sent to you on the website and provide the opportunity to opt out of further contact with us at any point.

Your rights

Access to your information – You have the right to request a copy of the personal information about you that we hold. 

Correcting your information – We want to make sure that your personal information is accurate, complete and up to date and you may ask us to correct any personal information about you that you believe does not meet these standards.

Deletion of your information – You have the right to ask us to delete personal information about you where:

  • You consider that we no longer require the information for the purposes for which it was obtained
  • We are using that information with your consent and you have withdrawn your consent – see Withdrawing consent to using your information below
  • You have validly objected to our use of your personal information – see Objecting to how we may use your information below
  • Our use of your personal information is contrary to law or our other legal obligations.

 

Objecting to how we may use your information – You have the right at any time to require us to stop using your personal information for direct marketing purposes.  In addition, where we use your personal information to perform tasks carried out in the public interest or pursuant to the legitimate interests of us or a third party then, if you ask us to, we will stop using that personal information unless there are overriding legitimate grounds to continue.

Restricting how we may use your information – in some cases, you may ask us to restrict how we use your personal information.  This right might apply, for example, where we are checking the accuracy of personal information about you that we hold or assessing the validity of any objection you have made to our use of your information.  The right might also apply where this is no longer a basis for using your personal information but you don't want us to delete the data.  Where this right to validly exercised, we may only use the relevant personal information with your consent, for legal claims or where there are other public interest grounds to do so.

Portabilityif we process personal information that you provide to us on the basis of consent or because it is necessary for the performance of a contract to which you are party, and in either case that processing is carried out by automated means, then you have the right to have that personal information transmitted to you in a machine readable format. Where technically feasible, you also have the right to have that personal information transmitted directly to another controller.

Automated processing – if we use your personal information on an automated basis to make decisions which significantly affect you, you have the right to ask that the decision be reviewed by an individual to whom you may make representations and contest the decision.  This right only applies where we use your information with your consent or as part of a contractual relationship with you

Withdrawing consent using your information – Where we use your personal information with your consent you may withdraw that consent at any time and we will stop using your personal information for the purpose(s) for which consent was given.

Privacy Policy for Course Participants

Privacy Notice pursuant to Article 13 of Regulation (EU) 2016/679 (GDPR) regarding the processing of personal data

Dear Sir/Madam, we wish to inform you that Regulation (EU) 2016/679 (GDPR) governs the methods and limits of personal data processing.

Based on the provisions of the regulation, your data will be processed in a lawful, fair and transparent manner.

Your data will therefore be collected for specific, explicit and legitimate purposes and will be processed for a determined period of time and, in any case, not exceeding 10 years from the last contact.

That said, pursuant to Article 13 of the GDPR, we hereby provide you with all the information you need, attempting to answer the main questions you might deem appropriate to ask us:

1. WHAT DATA DO I NEED TO PROVIDE YOU?

For the establishment and performance of our contractual relationship, we do not require particularly sensitive data. We therefore ask you to provide us only with your personal details (name, surname, business email) and certain contact details so that we can manage your accounting position (e.g., for issuing invoices) as well as to better organise our services.

2. WHO WILL PROCESS MY DATA?

The data you provide by responding to this email will be sent to two different Data Controllers:

  • for course organisation activities, sending instructions on course participation, sending connection links to video conferencing platforms (Zoom, Microsoft Teams and similar) if courses are online, customer management and billing management will be sent to Scotwork Italia S.r.l. with registered office at Viale Gran Sasso, 11 - 20131 Milano (MI) (info.it@scotwork.com).
  • for administrative management activities of customer records, for access to online digital tools and for carrying out "follow-up" (see point 3 c) of this document), will be sent to Scotwork Limited with offices at Academy Office Business Park, Building 11000, 51 Gower Street, Glasgow, G51 1PR, United Kingdom (info@scotwork.com).

3. FOR WHAT PURPOSES?

The data you provide will be processed for the following purposes:

a) Purposes connected and instrumental to the obligations arising from the contract (e.g.: management of bookings and administrative position). Educational purposes also fall within such scope. In this regard, recordings of courses may be made which will be viewed within the same session to highlight attitudes and inclinations in participants' negotiation skills. At the end of each day the recordings will be deleted.

b) Marketing (mailing lists and various advertising, including follow-up and telephone contacts).

c) Statistical purposes, although, it should be noted, in this case the data will first be anonymised and then processed in aggregate form.

Scotwork Italia S.r.l. (as well as Scotwork Limited) will not carry out any further processing in the absence of your prior consent or other "Legal Basis" that justifies, pursuant to Article 6 (GDPR), the use of your personal information.

4. TO WHOM WILL YOU DISCLOSE MY DATA?

Your data may be disclosed to third parties solely for the purpose of fulfilling contractual and/or legal obligations. In any case, before disclosing your data, we will take care to properly appoint third parties through the stipulation of "Data Processor" appointment agreements with which the operations delegated to the third party and the security measures to be adopted in order to best protect your information will be analytically outlined.

5. AM I OBLIGED TO PROVIDE YOU WITH DATA?

You are in no way obliged to provide us with your personal data.

However, the provision of data functional to the processing referred to in letter (a) is necessary to enable us to properly perform the contract. This processing does not require your consent; however, any refusal on your part to provide such data will result in the impossibility of continuing our contractual relationship.

Differently, the provision of data for the processing referred to in letter (b) is to be considered optional and any refusal to provide such data will not in any way prejudice the possibility of proceeding with the performance of the contract you have entered into with Scotwork Italia S.r.l..

Finally, the processing of data referred to in point (c) involves their use in an anonymous manner, and does not require your consent in this regard.

6. ONCE I PROVIDE DATA, WILL I LOSE CONTROL OF IT?

No! Once you provide data you will always have the possibility to affect their processing.

In particular, pursuant to Article 15 of the GDPR, you will always have the right to obtain from the data controller confirmation as to whether or not processing of personal data concerning you is underway and, in such case, to obtain access to the personal data and to the information indicated in the aforementioned article.

Furthermore, you are granted the right to obtain, pursuant to Articles 16 et seq. of the GDPR, the rectification, erasure and restriction of processing of your personal data held by the controller. Finally, you are granted pursuant to Article 77 of the GDPR the possibility to lodge a complaint with the supervisory authority of the Member State in which you reside/work or of the place where the alleged infringement occurred.

To exercise these rights it will be sufficient for you to contact the Data Controllers (indicated in point 2 of this document) who will respond, separately, for their respective areas of competence.

7. WILL MY DATA BE SUBJECT TO AUTOMATED DECISION-MAKING PROCESSES?

Your data will be managed for the sole purposes indicated above and, therefore, no intervention by decision-making processes by computer programmes is envisaged.

Authorisation for the use of image

We remind you that for the conduct of the course, recordings of the exercises will be made and the videos will be used for the sole purposes permitted by the laws in force and attributable to the processing indicated above with letter (a) with respect for decorum, dignity and your reputation. Furthermore, your recordings will not in any way be disseminated outside of the courses.

Informativa ex art. 13 Regolamento (UE) 2016/679 (GDPR) in materia di trattamento dei dati personali

Gentile Signore/a, desideriamo informarLa che il Regolamento (UE) 2016/679 (GDPR) disciplina i modi ed i limiti del trattamento di dati personali.

Sulla base di quanto stabilito dalla normativa, i Suoi dati saranno trattati in modo lecito, corretto e trasparente.

I Suoi dati saranno quindi raccolti per finalità determinate, esplicite e legittime e saranno trattati per un periodo di tempo determinato e, in ogni caso, non superiore ad anni 10 dall'ultimo contatto.

Ciò premesso, ai sensi dell'articolo 13 del GDPR, con la presente Le forniremo tutte le informazioni di cui ha bisogno, cercando di rispondere alle principali domande che potrebbe ritenere opportuno rivolgerci:

1. QUALI DATI DEVO FORNIRVI?

Per l'instaurazione e l'esecuzione del nostro rapporto contrattuale, non necessitiamo di dati particolarmente sensibili. Le chiediamo quindi di fornirci solamente la sua anagrafica (nome, cognome, e-mail aziendale) e taluni dati di contatto così da poter gestire la Sua posizione contabile (es. per emissioni di fatture) nonché per poter meglio organizzare i nostri servizi.

2. CHI TRATTERÁ I MIEI DATI?

I dati da Lei comunicati rispondendo a questa e-mail verranno inviati a due differenti Titolari del Trattamento:

  • per le attività di organizzazione dei corsi, invio di istruzioni sulla partecipazione ai corsi, invio di link di collegamento a piattaforme di videoconferenza (Zoom, Microsoft Teams e simili) se i corsi sono online, gestione anagrafica e gestione fatturazione verranno inviati a Scotwork Italia S.r.l. con sede legale Viale Gran Sasso, 11 - 20131 Milano (MI) (info.it@scotwork.com).
  • per le attività di gestione amministrativa delle anagrafiche, per l'accesso ai tool digitali online e per l'effettuazione di "follow-up" (si veda punto 3 c) di questo documento), verranno inviati a Scotwork Limited con sede in Academy Office Business Park, Building 11000, 51 Gower Street, Glasgow, G51 1PR, Regno Unito (info@scotwork.com).

3. PER QUALI FINALITÁ?

I dati da Lei forniti verranno trattati per le seguenti finalità:

a) Finalità connesse e strumentali agli obblighi derivanti dal contratto (es: gestione della prenotazione e della posizione amministrativa). Rientrano in tali scopi altresì le finalità didattiche. In tal senso potrebbero essere effettuate delle riprese dei corsi che verranno visionate nell'arco della medesima seduta per evidenziare attitudini e inclinazioni nella capacità di negoziazione dei partecipanti. Al termine di ogni giornata le riprese saranno cancellate.

b) Marketing (mailing list e pubblicità varie, compresi follow-up e contatti telefonici).

c) Scopi statistici, anche se, si precisa, in questo caso i dati saranno dapprima anonimizzati e poi trattati in forma aggregata.

Scotwork Italia S.r.l. (così come anche Scotwork Limited) non effettuerà alcun trattamento ulteriore in mancanza di un Suo previo consenso o di altra "Base Giuridica" che giustifichi, ai sensi dell'art. 6 (GDPR), l'utilizzo delle sue informazioni personali.

4. A CHI COMUNICHERETE I MIEI DATI?

I Suoi dati potrebbero essere comunicati a soggetti terzi al solo fine di adempiere ad obblighi contrattuali e/o di legge. In ogni caso, prima di comunicare i Suoi dati, sarà nostra premura incaricare opportunamente i terzi mediante stipula di accordi di nomina a "Responsabile del Trattamento" con i quali verranno delineate analiticamente le operazioni delegate al terzo e le misure di sicurezza da adottare al fine di tutelare al meglio le Sue informazioni.

5. SONO OBBLIGATO A FORNIRVI I DATI?

Lei non è in alcun modo obbligato a fornirci i Suoi dati personali.

Tuttavia, il conferimento dei dati funzionali al trattamento di cui alla lettera (a) è necessario per consentirci la corretta esecuzione del contratto. Tale trattamento non necessita del Suo consenso; tuttavia, un eventuale Suo rifiuto a conferire detti dati avrà come conseguenza l'impossibilità di proseguire il nostro rapporto contrattuale.

Differentemente, il conferimento dei dati per i trattamenti di cui alla lettera (b) è da ritenersi facoltativo ed un eventuale rifiuto a conferire tali dati non pregiudicherà in alcun modo la possibilità di procedere con l'esecuzione del contratto da Lei stipulato con Scotwork Italia S.r.l..

Infine, il trattamento dei dati di cui al punto (c) prevede l'utilizzo degli stessi in maniera anonima, e non necessita di un suo consenso a riguardo.

6. UNA VOLTA CONFERITI I DATI, NE PERDERÓ IL CONTROLLO?

No! Una volta conferiti i dati avrà sempre la possibilità di incidere sul loro trattamento.

In particolare, ai sensi dell'art. 15 del GDPR, Lei avrà sempre il diritto di ottenere dal titolare del trattamento la conferma che sia o meno in corso un trattamento di dati personali che La riguardano e, in tal caso, di ottenere l'accesso ai dati personali e alle informazioni indicate nel suddetto articolo.

Inoltre, Le è riconosciuto il diritto di ottenere, ai sensi degli articoli 16 e seguenti del GDPR, la rettifica, la cancellazione e la limitazione al trattamento dei Suoi dati personali in possesso del titolare. Infine, Le è riconosciuta ai sensi dell'art. 77 del GDPR la possibilità di proporre reclamo all'autorità di controllo dello Stato membro in cui risiede/lavora oppure del luogo ove si è verificata la presunta violazione.

Per esercitare tali diritti Le sarà sufficiente contattare i Titolari del Trattamento (indicati al punto 2 del presente documento) i quali risponderanno, disgiuntamente, per le proprie aree di competenza.

7. I MIEI DATI SARANNO SOTTOPOSTI A PROCESSI DECISIONALI AUTOMATIZZATI?

I suoi dati verranno gestiti per le sole finalità sopra indicate e, pertanto, non è previsto l'intervento di processi decisionali da parte di programmi informatici.

Autorizzazione all'utilizzo dell'immagine

Le ricordiamo che per lo svolgimento del corso saranno realizzate le riprese delle esercitazioni ed i video saranno utilizzati per i soli scopi consentiti dalle leggi vigenti e riconducibili al trattamento sopra indicato con la lettera (a) nel rispetto del decoro, della dignità e della Sua reputazione. Inoltre, Le Sue riprese non verranno in alcun modo diffuse all'esterno dei corsi.
